1. Acceptance and Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Canvasvex ("we," "us," "our," or "the Store"), governing your access to and use of the website located at canvasvex.myshopify.com (the "Site"), and all products, services, and content made available through the Site. By accessing, browsing, placing an order, creating an account, or otherwise using any aspect of our Site or services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein. If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site and all associated services.

You must be at least eighteen (18) years of age, or the age of majority in your state or jurisdiction of residence (whichever is greater), to use the Site and place orders. By using the Site, you represent and warrant that you meet this age requirement and possess the legal capacity and authority to enter into a binding contract under applicable law. If you are accessing or using the Site on behalf of a business entity, organization, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms, and references to "you" shall include both you individually and that entity.

Minors who do not meet the minimum age requirement may use the Site only under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms and assumes full responsibility for the minor's use of the Site and compliance with these Terms.

2. The Store and Products

Canvasvex offers a curated selection of canvas prints, wall art, and related products for purchase online. All product descriptions, images, specifications, dimensions, colors, materials, features, and other content displayed on the Site are provided for general informational purposes. While we make commercially reasonable efforts to ensure that all product information is accurate, complete, and current, we do not warrant or guarantee the accuracy, completeness, reliability, or timeliness of any product descriptions, images, pricing, availability, or other content on the Site.

Product images are intended to represent the items offered for sale as accurately as possible; however, actual product appearance, color, texture, size, and other characteristics may vary due to differences in monitor and device display settings, photographic lighting conditions, manufacturing variations, materials sourcing, and other factors beyond our control. We do not guarantee that product colors or details will appear on your screen exactly as they appear in person.

Product availability is subject to change without notice. We reserve the right to discontinue any product, modify product offerings, update product specifications, change suppliers, and limit quantities available for purchase at any time without prior notice or liability. The inclusion of any product on the Site does not constitute an offer to sell; rather, it is an invitation for you to make an offer to purchase, which we may accept or decline in our sole discretion as described in Section 3 below.

3. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the selected products on these Terms and at the price and specifications stated at the time of order placement. Your order constitutes an offer that remains subject to acceptance by Canvasvex. The submission or placement of an order does not, by itself, create a binding contract or guarantee that your order will be accepted or fulfilled.

After you submit an order, you may receive an automated order confirmation email acknowledging our receipt of your order. This confirmation email is not an acceptance of your order or a confirmation that your order will be fulfilled; it is merely an acknowledgment that we have received your order request. A binding contract between you and Canvasvex for the purchase of products is formed only when we ship the products to you or send you a specific confirmation that your order has been accepted and is being processed for shipment.

We reserve the right, in our sole discretion and without liability, to accept, reject, cancel, limit, or refuse any order for any reason, including but not limited to: product unavailability or out-of-stock conditions; errors or inaccuracies in product or pricing information; credit or fraud concerns; failure of payment authorization or verification; suspected fraudulent, unauthorized, or illegal activity; limitations on quantities available for purchase; your breach of these Terms; shipping or delivery restrictions; operational, technical, or logistical constraints; or any other commercial reason. If we cancel your order after payment has been processed, we will refund the full amount charged to your original payment method.

Orders placed through the Site are generally processed within one (1) to two (2) business days following order acceptance. You are responsible for providing complete, accurate, and current information during checkout, including billing address, shipping address, contact telephone number, and email address. Canvasvex is not responsible for any delay, non-delivery, or other issue arising from incorrect, incomplete, or outdated information provided by you.

4. Pricing and Sales Tax

All prices displayed on the Site are stated in United States Dollars (USD) and are exclusive of applicable taxes unless expressly stated otherwise. Prices are subject to change at any time without prior notice; however, changes to pricing will not affect orders for which we have already sent you an order acceptance confirmation.

The prices displayed on the Site do not include sales tax, use tax, excise tax, value-added tax, goods and services tax, or other taxes, duties, or governmental charges (collectively, "Taxes"). Applicable sales tax will be calculated and added to your order total at checkout based on the shipping destination address and the tax rates in effect at the time of purchase, in accordance with applicable federal, state, and local tax laws. The amount of tax charged will be displayed in your shopping cart and order summary before you complete your purchase. You are responsible for paying all applicable Taxes associated with your purchase.

In the event of a pricing error, whether caused by technical malfunction, human error, data transmission issue, or any other cause, we reserve the right to cancel any orders placed at the incorrect price, even after an order confirmation has been sent, and to refund any amounts charged. We will notify you if a pricing error is discovered and offer you the opportunity to purchase the product at the correct price or cancel your order for a full refund.

5. Payment

Payment for all orders must be made in full at the time of purchase. We accept major credit cards, debit cards, and such other payment methods as may be indicated on the Site at checkout. All payments are processed securely through third-party payment processors in compliance with applicable payment card industry data security standards (PCI DSS).

By submitting payment information, you represent and warrant that: (a) you are legally authorized to use the payment method provided; (b) the payment information you provide is true, accurate, complete, and current; (c) charges incurred by you will be honored by your payment method issuer; and (d) you will pay all charges incurred at the prices in effect when such charges are incurred, including all applicable taxes.

You authorize us (and our third-party payment processors) to charge your provided payment method for the total amount of your order, including the purchase price of products, any applicable shipping charges (if any), and all applicable Taxes. If your payment method is declined, fails, or cannot be verified, we may suspend or cancel your order and reserve the right to refuse or limit future orders until the payment issue is resolved.

We reserve the right to request additional verification, documentation, or information from you prior to accepting or processing any order, particularly in cases involving high-value purchases, suspected fraud, unusual purchasing patterns, mismatched billing and shipping information, or other red flags. Failure to provide requested information may result in order cancellation.

6. Shipping and Delivery

Shipping policies, procedures, delivery timeframes, and related terms are set forth in detail on our Shipping Policy page, which is incorporated into these Terms by reference. Please review the Shipping Policy carefully before placing an order.

Orders are generally processed within one (1) to two (2) business days following order acceptance and are delivered within approximately three (3) to five (5) business days for destinations within the United States. These delivery timeframes are estimates only and are not guaranteed. Actual delivery times may vary based on your shipping address, carrier performance, weather conditions, holidays, customs processing (for international shipments, if applicable), and other factors beyond our control.

Shipping within the United States is provided free of charge. There are no shipping costs or fees for domestic orders. All shipments are made to the shipping address you provide at checkout; we do not ship to P.O. boxes where carrier restrictions apply. Title and risk of loss pass to you upon our delivery to the carrier.

We are not responsible for delays, loss, or damage occurring during transit after the products have been delivered to the carrier. If your shipment is delayed, lost, or damaged, you should contact the carrier directly to file a claim. We will reasonably cooperate with you and the carrier to help resolve shipping issues, but we do not guarantee delivery by any specific date and are not liable for any damages, losses, or expenses resulting from shipping delays or carrier performance failures.

7. Returns and Refunds

Our return and refund policies, procedures, conditions, and eligibility requirements are set forth in detail on our Returns & Refunds Policy page, which is incorporated into these Terms by reference. Please review the Returns & Refunds Policy carefully before placing an order.

We offer a thirty (30) day return window measured from the date of delivery. This return window is our voluntary store policy; there is no statutory "cooling-off period" or right of withdrawal for online purchases under U.S. federal law. Eligible returns must comply with all conditions and requirements set forth in our Returns & Refunds Policy, including but not limited to: timely initiation of the return, products in original condition, proper packaging, and adherence to return authorization procedures.

Returned items must be unused, undamaged, in their original packaging with all tags and labels attached, and in a condition suitable for resale. Custom, personalized, and made-to-order products may not be eligible for return unless defective or damaged. The Returns & Refunds Policy specifies who is responsible for return shipping costs and the process for obtaining refunds, exchanges, or store credit.

Refunds, if approved, will be issued to the original payment method used for the purchase. Please allow reasonable processing time for your financial institution to post the refund to your account. We reserve the right to refuse returns that do not meet our policy requirements or that are initiated outside the return window.

8. Intellectual Property

All content, materials, features, functionality, and elements available on or through the Site, including but not limited to text, graphics, logos, images, photographs, illustrations, artwork, product designs, icons, button designs, software, code, data compilations, layout, look and feel, audio, video, and the selection and arrangement thereof (collectively, "Site Content"), are owned by Canvasvex, our licensors, suppliers, or other third-party content providers, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Canvasvex name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Canvasvex or our affiliates or licensors. You may not use, copy, reproduce, modify, or display such trademarks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Site Content solely for your personal, non-commercial use and for the purpose of browsing, evaluating, and purchasing products offered through the Site. This license does not include any right to: (a) reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Site Content, except as incidentally necessary for normal web browsing and order placement; (b) use any data mining, robots, scraping, or similar automated data gathering or extraction methods; (c) use the Site or Site Content for any commercial purpose or for the benefit of any third party; or (d) remove, obscure, or alter any copyright, trademark, or other proprietary rights notices contained in or on the Site or Site Content.

Any unauthorized use of the Site or Site Content is strictly prohibited and may violate copyright, trademark, and other intellectual property laws, as well as applicable communications regulations and statutes, and may subject you to civil and criminal liability. You agree not to engage in any activity that interferes with or disrupts the Site or servers and networks connected to the Site.

9. Acceptable Use

As a condition of your use of the Site, you agree not to use the Site for any purpose that is unlawful, prohibited by these Terms, or in any manner that could damage, disable, overburden, or impair the Site. You agree not to:

Violate any applicable federal, state, local, or international law, regulation, or ordinance;
Infringe or misappropriate the intellectual property rights, privacy rights, publicity rights, or other legal rights of Canvasvex or any third party;
Transmit or upload any viruses, malware, Trojan horses, spyware, or other malicious code or harmful components;
Attempt to gain unauthorized access to any portion of the Site, user accounts, computer systems, or networks connected to the Site, through hacking, password mining, or any other means;
Interfere with or disrupt the integrity, performance, or operation of the Site or the servers or networks connected to the Site;
Use any automated means, including robots, spiders, scrapers, or other automated tools, to access, monitor, or copy any content or information from the Site without our express written permission;
Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity, or use a false identity;
Collect, harvest, or compile information about other users of the Site without their consent;
Post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, ethnically, or otherwise objectionable;
Engage in any fraudulent activity, including using stolen credit cards or payment credentials, providing false information, or engaging in chargeback fraud;
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Site or any software or systems used to provide the Site;
Frame or mirror any part of the Site without our prior written authorization;
Use the Site to transmit unsolicited advertising, promotional materials, spam, or other forms of solicitation; or
Encourage, assist, or enable any other person to do any of the foregoing.

We reserve the right, in our sole discretion and without notice or liability, to investigate, suspend, terminate, or restrict your access to the Site if we believe you have violated these Terms or engaged in conduct that we deem inappropriate, harmful, or inconsistent with the letter or spirit of these Terms. We may also report any suspected illegal activity to law enforcement authorities and cooperate with such authorities in any investigation or prosecution.

10. Disclaimers of Warranties

THE SITE, ALL SITE CONTENT, AND ALL PRODUCTS AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CANVASVEX DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

CANVASVEX DOES NOT WARRANT THAT THE SITE, SITE CONTENT, PRODUCTS, OR SERVICES WILL MEET YOUR REQUIREMENTS; THAT THE SITE WILL BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES
